Where a project involves specifications, drawings, manufacturer requirements or other technical documentation, the customer is responsible for providing relevant information required for Factory Worx Co to complete the agreed works.

Any additional work outside the agreed scope may require further approval and may result in additional charges.

5. Customer Responsibilities

Customers are responsible for providing accurate and relevant information about the project and the required works.

Customers should provide reasonable access to the work area and ensure that Factory Worx Co can safely and appropriately access the areas covered by the agreed scope of works.

Customers are also responsible for notifying Factory Worx Co of any known site conditions, restrictions, hazards, project requirements or relevant specifications that may affect the works.

Delays caused by circumstances outside Factory Worx Co's reasonable control may affect project scheduling.

6. Site Conditions and Additional Works

The scope and price of works may be affected by conditions that could not reasonably be identified before work begins.

Where additional works become necessary because of unexpected site conditions, additional defects, changes to the project or changes requested by the customer, Factory Worx Co may discuss the additional requirements and any associated costs with the customer before proceeding where reasonably practicable.

7. Scheduling

Factory Worx Co aims to complete works efficiently and in accordance with agreed project schedules.

Construction projects may involve multiple contractors, site access requirements, weather conditions, material availability and other circumstances outside Factory Worx Co's reasonable control.

Where circumstances outside our control affect a scheduled date, Factory Worx Co will communicate with the customer and work to arrange an alternative suitable time where reasonably practicable.

8. Payment

Payment terms, deposit requirements, progress payments and final payment arrangements will be specified in the applicable quotation or agreement.

Invoices must be paid according to the payment terms stated on the relevant invoice or agreement.

Factory Worx Co reserves the right to suspend or delay further works where an invoice remains unpaid beyond the agreed payment terms, subject to any rights and obligations under applicable Australian law.

9. Cancellations and Changes

Customers should provide reasonable notice if they need to cancel, postpone or change scheduled works.

Any cancellation, postponement or change may affect project scheduling and may result in reasonable costs where applicable and permitted by law.

The specific terms applicable to a particular project will be set out in the relevant quotation or agreement.

10. Workmanship

Factory Worx Co aims to provide reliable service and quality workmanship across all agreed works.

The finished result may be affected by existing surfaces, substrates, construction conditions, materials, weather, access and other factors outside Factory Worx Co's control.

Any concerns regarding completed works should be raised with Factory Worx Co as soon as reasonably practicable so that the matter can be reviewed.

11. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or guarantees that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

Where Australian Consumer Law applies, customers retain all applicable rights and remedies provided by law.

12. Limitation of Liability

To the extent permitted by law, Factory Worx Co will not be responsible for loss or damage caused by circumstances outside its reasonable control, including pre-existing defects, inaccurate information supplied by a customer, restricted access, other contractors, site conditions or changes to project requirements.

Nothing in these Terms & Conditions excludes liability where doing so would be unlawful.

13. Website Content and Intellectual Property

Unless otherwise stated, content appearing on the Factory Worx Co website, including text, graphics, branding, photographs and other materials, belongs to Factory Worx Co or is used with appropriate permission.
